What is the Motion to Reopen?

A Motion to Reopen Immigration is a legal remedy that allows individuals who have received a deportation or removal order to request a new review of their case. BIA appeals are typically made in writing and must be filed within a certain period of time after the initial decision is made.

During the BIA appeal process, the BIA will review the case and make a decision. The decision of the BIA can either affirm, reverse, or remand the initial decision made by the immigration judge or officer.
